The ( "Pembroke Welsh Corgi") puppy described above is sold for the sum of $ .00.
A pet puppy is defined here to be a ("Pembroke Welsh Corgi") puppy which is in good health
at the time of sale, and embodies the characteristics of the("Pembroke Welsh Corgi ") breed. This puppy is purebred and is
registerable /registered. This puppy is/or will be registered with a limited registration, which prohibits breeding and registering
offspring. The BUYER agrees this puppy is to be altered at the appropriate age, (4-8 months) and
veterinarian confirmation of this procedure must be supplied to the breeder. Altered animals live longer, healthier lives.
Spaying a bitch before her first heat greatly reduces the risk of her developing mammary cancer and eliminates the chance
of life threatening uterine infections (pyometra). Altering a male eliminates the risk of his developing bacterial prostatis
or testicular cancer. The purchase of this puppy is CONDITIONAL until this requirement is fulfilled, and the dog may be repossessed
by the BREEDER if it is not met within the specified time. When the BREEDER receives a copy of the spay/neuter certificate,
a refund of $50 will be given to the BUYER.
The BREEDER guarantees the above described puppy to be healthy at the time of the sale.
The BREEDER has had this puppy veterinarian checked for any physical abnormalities including, eyes, ears, lungs, heart, etc.
and the puppy has been found normal & healthy. All appropriate shots for the puppy's age have been given, and a record
of this exam & vaccination history is supplied. BUYER understands the importance of keeping the puppy safe and not exposed
to communicable disease and understands that until the puppy receives a full course of immunizations, it can contract diseases
and breeder is not responsible for any illness or death that results from puppy being exposed to disease by the BUYER (ie.
Taking it to a dog park/store or allowing it to play on the floor at the vet office.)
The BREEDER does not assume any liability for any injury
to said puppy after delivery/pickup.
All puppies are sold on a 72-hour trial basis, during which time the BUYER's veterinarian should check the puppy. If the BUYER is not completely satisfied with the puppy, the puppy must be returned to the BREEDER, at the BUYER's expense, for a full refund of the purchase price, within 48 hours of notifying the BREEDER' that the puppy
is to be returned. BREEDER will provide BUYER with a replacement breed quality puppy as soon as such a puppy is available
to BREEDER, or refund 100% of purchase price. BREEDER strongly recommends that BUYER have puppy examined by a licensed veterinarian
of BUYER's choice within 72 hours of receipt of puppy. If buyer chooses not to take animal to a licensed veterinarian within
72 hours of acceptance, all guarantees are null and void. After 72 hours, the only warranty the puppy is covered under is
the congenital defect warranty outlined below. BUYER is advised to send BREEDER a copy of
vet findings from this initial exam. The BUYER agrees to maintain the puppy's health in good condition, and to provide yearly
examinations, vaccinations, parasite treatments, and any other usual procedures necessary to assure good health. Puppy must
visit a licensed vet for a rabies vaccination. BUYER may choose to give their own routine shots, wormings, and flea/tick tretments.
HEALTH GUARENTEE/CONGENITAL DEFECT WARRANTY
The BREEDER has done everything possible to produce
healthy sound puppies/dogs both by breeding only dogs (parents) that are free to their knowledge of eye problems, (The parent(s)
and/or grandparents of this puppy have had a CERF examine to establish that they are free of eye problems. ) hip and elbow
dysplasia, (The parent(s) and/or grandparents of this puppy have had x-rays to establish that they are free of hip and elbow
dysplasia.), VwD. and by raising the puppies in the best way possible in regards to diet, exercise, socialization and veterinary
care. The BREEDER cannot guarantee a puppy they produce or sell will not eventually have health issues. No one can. BREEDER can only say they have done all they can do to eliminate possible problems. There are NO guarantees in life for
anything regarding living beings. These are not machines; these are living, breathing creatures and consequently, there are
This puppy comes with a Health guarantee. BREEDER
makes no guarantee regarding loss of the puppy because of accidental death, theft, sickness, etc., or any other loss beyond
BREEDER's control, except as stated above.
Congenital Defects: The BREEDER guarantees the puppy against terminal congenital defects
until the age of one (1) year. In the event the dog is diagnosed with a terminal congenital defect, the BUYER must notify
the BREEDER in writing and provide a statement of diagnosis from two (2) veterinarians (one of whom may be chosen by the BREEDER)
stating that the dog must be euthanized due to a defect of genetic origin. A replacement puppy or refund will be provided
according to the "Conditions of Replacement" listed below.Dysplasia: The BREEDER guarantees the puppy against crippling hip
or elbow dysplasia (defined as changes in the joint that are manifest by lameness and an inability to function as a pet) until
two years of age. As dysplasia is caused by a combination of genetic, nutritional and environmental factors, it is not possible
to guarantee against any dysplasia. If the dog develops crippling dysplasia, the BUYER must notify the BREEDER in writing
and provide a statement of diagnosis from two (2) veterinarians, one of whom may be chosen by the BREEDER. A replacement puppy
or refund will be provided according to the "Conditions of Replacement" listed below. The guarantee against dysplasia is null
and void if the dog has not been maintained at proper weight (defined as easily palpable ribs,.
and/or dysplasia has resulted from over exercise, neglect, etc.
Conditions of Replacement: In addition to the veterinarians’
statements listed above, replacement conditions are as follows:
1) The dog must be euthanized.
2) The dog must not have whelped or sired a litter after placement with the BUYER.
3) The original BUYER must own the dog.
4) The replacement puppy will be of approximately equal quality in terms of conformation.
5) All shipping costs on the replacement puppy are borne by the BUYER. Shipping costs may include,
but are not limited to, health certificates
and vaccinations required for interstate travel, crate rental or purchase, and actual shipping
6) The final decision to replace a puppy, and the timing of such a replacement, or to provide
a full or partail refund is at the discretion of the
BREEDER shall not be held responsible for the development
of breed standard faults, diseases, or disorders, which are due to BUYER's negligence. The puppy must have been under
the care of a licensed veterinarian during the time the puppy was in the care of the BUYER and provide substantial proof that
the puppy's health was maintained by appropriate medical attention, any necessary medications, and appropriate nutrition during
that period the puppy was in the BUYER's possession. Under no conditions and at no time during
the life of the puppy will BREEDER pay or assist in paying veterinary expenses after the puppy is purchased, including any
such expenses directly or indirectly related to any inheritable/genetic defects.
There are many factors that can influence growth and development, such as diet, exercise,
weight gain, etc.. The BUYER assumes the responsibility to carry on with the appropriate
vaccinations, exercise and feeding schedule, as supplied by the BREEDER. MOST PARTICULARLY, the BUYER agrees to keep the puppy
slim throughout it's normal growth period. The BREEDER can offer no further guarantees other
then stated in this contract, once the care of the puppy is no longer under their control.
1. BREEDER strongly recommends that BUYER attend obedience classes with puppy and provide proper socialization opportunities for puppy.
2. BREEDER shall not be held responsible for acts of
puppy, which are due to BUYER's negligence.
The BUYER agrees to provide a suitable fenced area for this puppy if it is to be outdoors.
The BUYER agrees that neither he/she nor the BUYER's estate/executors may sell this puppy or
transfer ownership of this puppy without the BREEDER's knowledge and consent. The BUYER agrees to notify the BREEDER of any
changes of address during the puppy's lifetime.
The BUYER agrees that if, for any reason, he/she is unable to keep the dog at anytime during
the dog’s life, whether co-owned or under the sole ownership of the BUYER, the BREEDER shall be notified, and the BREEDER
will have the first choice to either: (a) take the puppy back or (b) assist the BUYER in finding a suitable home for the puppy.
THIS IS AGREED TO BY THE BUYER AS A CONDITION OF THE SALE OF THE PUPPY. If the dog is returned in good health, the BREEDER
will refund the following amounts to the BUYER, less any expenses incurred by the BREEDER, after the dog has been placed in
an appropriate home:
From 72 hours up to 3 months after the time of sale – 75% of purchase price; From 3 months
up to 1 year after the time of sale – 50% of purchase price; From 1 year up to 2 years after the time of sale –
30% of purchase price; From 2 years up to 4 years after the time of sale – 20% of purchase price; From 4 years on after
the time of sale –no monetary refund.
Furthermore, the BUYER agrees to sign the necessary papers to transfer the sole ownership of
the dog back to the BREEDER. This includes, but is not limited to, the American Kennel Club registration, & the United
Kennel Club registration. The BREEDER will deduct the cost of veterinary and/or grooming care from the refund on any dog returned
in poor condition. Poor condition includes, but is not limited to, malnutrition, parasites, sickness, matted coat and/or disability.
No refund will be given for a returned dog that has suffered abuse or neglect.
The Breeder neither makes or implies any warranties or guarantees, express or implied, other
than those written in the agreement including, without limitation, the warranties of merchantability and fitness. This document
constitutes the entire agreement between the Breeder and Buyer with respect to this sale. The Buyer's signature below indicates
that he/she has read, agrees and does understands all the conditions of the Sales Agreement and Contract of Sale. Buyer and
Breeder agree that this Agreement will be governed by the laws of the State of California and may not be altered, modified
or rescinded unless agreed to in writing by Buyer and Seller. All business is conducted in the State of California, Town of
Cherry Valley. Any and all legal action will take place in Riverside, California and is subject to California Law.
The undersigned agree to uphold all covenants of this Agreement as of this____________ day
